Private Policy

This Acceptable Use and Conduct Policy (“Policy”) governs your use of the products and services offered by WORKWILD PRO and its affiliates (“we”, “our”, “us”, and “Products”, respectively) and our websites and their subdomains, together with any successor websites (“WORKWILD PRO Sites”). We may modify this Policy by posting a revised version on a WORKWILD PRO Site. By using the Products or accessing a WORKWILD PRO Site, you agree to the latest version of this Policy.

You may not use, or facilitate or allow others to use the Products or a WORKWILD PRO Site:

  • for any illegal, invasive, infringing, defamatory, or fraudulent activity (including, for example, phishing, creating a pyramid scheme or mirroring a website);
  • to violate or encourage the violation of the rights of others;
  • to threaten, incite, promote, or actively encourage violence, terrorism, or other serious harm;
  • for any content or activity that promotes child sexual exploitation or abuse, is pornographic, harassing, excessively profane, hateful (including attacking others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical condition, or is otherwise exploitive or abusive), or otherwise objectionable as determined by WORKWILD PRO in its sole discretion;
  • to violate the security, integrity, or availability of any user, network, computer or communications system, software application, network, or computing device;
  • to distribute, publish, send, or facilitate the sending of unsolicited mass email or other messages, promotions, advertising, or solicitations (“spam”) including, without limitation:
  • sending communications or email in violation of the CAN-SPAM Act or any other applicable anti-spam law or regulation;
  • imitating or impersonating WORKWILD PRO another person or his, her, or its email address, or creating false accounts for the purpose of sending spam;
  • data mining or harvesting any web property to find email addresses or other user account information;
  • sending unauthorized mail via open, third-party servers;
  • sending email to users who have requested to be removed from a mailing list;
  • selling to, exchanging with, sharing with, or distributing third-party personal information, including the email addresses of any person without such person’s knowing and continued consent to such disclosure;
  • sending unsolicited emails to significant numbers of email addresses belonging to individuals and/or entities with whom you have no pre-existing relationship;
  • emailing an address obtained via Internet harvesting methods or any surreptitious methods (e.g., scraping or harvesting);
  • emailing an address that is incomplete, inaccurate and/or not updated for all applicable opt-out notifications, using best efforts and best practices in the industry,
  • to distribute, store or upload to the Products, viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature;
  • to conduct multi-level marketing, such as pyramid schemes and the like;
  • to generate or facilitate SMS, MMS, or other text messages or push notifications in violation of the Telephone Consumer Protection Act, the Do-Not-Call Implementation Act, or any other applicable law including anti-spam, telemarketing, or telephone consumer protection laws or regulations;
  • to find security vulnerabilities to exploit the Products or attempting to bypass any security mechanism or filtering capabilities.
  • in such a way as to misrepresent yourself, or disguise the origin of any content (including by “spoofing”, “phishing”, manipulating headers or other identifiers, impersonating anyone else, or falsely implying any sponsorship or association with WORKWILD PRO or any third party).

Conduct Guidelines – Interacting with WORKWILD PRO Employees

At WORKWILD PRO we pride ourselves on the diversity and capability of our global workforce and customers. We support honest, collaborative and respectful relationships and take a very firm line against bullying, harassment or abuse of our employees in any form of communication, including phone, text, messaging, email and others. Simply put, we do not tolerate behavior that:

  • Intimidates, shames or harasses others by any means;
  • Attacks human dignity using things such as degrading or demeaning stereotypes, including but not limited to race, nationality, gender or other stereotypes; or
  • Repeated or unwanted contact that insults bullies or threatens our employees.

 

Investigation and Enforcement

We may investigate any suspected violation of this Policy and remove or disable access to any content or resource that violates this Policy. You agree to cooperate with us to remedy any violation. We may report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Our reporting may include disclosing your information. We also may cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this Policy. We may immediately suspend your access to any Product, WORKWILD PRO Site, or other service if you are not in compliance with this Policy or don’t respond to us in a reasonable period of time after we’ve contacted you about a potential violation of this Policy. We may also suspend your access to any service or terminate any agreement of which this Policy forms a part.

Your Privacy

When you visit any website, it may store or retrieve information on your browser, mostly in the form of cookies. This information might be about you, your preferences or your device and is mostly used to make the site work as you expect it to. The information does not usually directly identify you, but it can give you a more personalized web experience. This Cookie Statement explains how WORKWILD PRO and its group companies (collectively “WORKWILD PRO, "we", "us", and "ours") use cookies and similar technologies to recognise you when you visit our Websites. It explains what these technologies are and why we use them, as well as your rights to control our use of them.

What are Cookies?

Cookies are small pieces of information stored on your hard drive, not on the WORKWILD PRO Website. Cookies set by the website owner (in this case, WORKWILD PRO) are called "first party cookies" Cookies set by parties other than the website owner are called "third party cookies". Third party cookies enable third party features or functionality to be provided on or through the website (e.g. like advertising, interactive content and analytics). Why do we use cookies?

We use first-party and third party cookies for several reasons. Some cookies are required for technical reasons in order for our Websites to operate, and we refer to these as "strictly necessary" cookies. Other cookies also enable us to track and target the interests of our users to enhance the experience on our Websites. Third parties serve cookies through our Websites for advertising, analytics and other purposes.

When processing your Personal Data, we may need to share it with other third parties (including other entities within our Group Companies). This list is non-exhaustive and there may be circumstances where we need to share Personal Data with other third parties

  • With third parties assisting WORKWILD PRO in providing our Customers with the Service(s) Our Sub-Processors are given access to Customers’ Account and Customer data only as reasonably necessary to provide the Service(s) and will be subject to confidentiality obligations in their service agreements;
  • With third party service providers providing us with services, such as research and analytics, anti-spamming and anti-phishing services, marketing and data enrichment or for them to reach out to you on our behalf;
  • With third party payment processors who process your credit card and other payment information for WORKWILD PRO but who are otherwise not permitted to store, retain or use such information;
  • With third party partners for the purpose of assisting us in onboarding you and providing any further support needed to use our Services;
  • With sponsors of contests for which you register;
  • With third-party service providers that are assisting us with the operation and administration of events. If we are running an event in partnership with other organizations, we will share your Personal Data with such organizations for use in relation to the event;
  • With third-party social media networks, advertising networks and websites;
  • With external recruiters, and related organizations such as third-party providers that undertake employee background checks on our behalf and on behalf of other entities within our Group Companies;
  • With auditors, lawyers, accountants and other professional advisers who advise and assist us in relation to the lawful and effective management of our organization and in relation to any disputes we may become involved in;
  • Law enforcement or other government and regulatory agencies and bodies or other third parties as required by, and in accordance with, applicable law or regulation;
  • With Affiliates within WORKWILD PRO and companies that we will acquire in the future when they are made part of the WORKWILD PRO group – this may be for customer support, marketing, technical operations, account management or organizational purposes and to provide, enhance and improve the Services;
  • If we are involved in a merger, reorganization or other fundamental corporate change with a third party, or sell/buy a business unit to/from a third party, or if all or a portion of our business, assets or stock are acquired by a third party, with such third party including at the due diligence stage;
  • Other third parties - Occasionally, we may receive requests from third parties with authority to obtain disclosure of Personal Data, such as to check that we are complying with applicable law and regulation, to investigate an alleged crime, or to establish, exercise or defend legal rights. We will only fulfil requests for Personal Data where we are permitted to do so in accordance with applicable law or regulation.
  • When you connect your Gmail mailbox with your WORKWILD PRO Account where necessary (such as when we transfer data to service providers) we put in place appropriate contractual arrangements and security mechanisms (including but not limited to: Data Processing Addendum and Standard Contractual Clauses) to protect the Personal Data shared and to comply with our data protection, confidentiality and security standards and obligations.
